Terms & Policies
Last updated August 9, 2026. These terms apply to all services, bookings, and recurring plans arranged through topshelfobx.com with Top Shelf OBX, LLC (dba Top Shelf Pressure Washing). By booking a service, paying a deposit, or subscribing to a maintenance plan, you agree to these policies.
Payment Processing & Security
All credit card, debit card, and automated recurring payments are processed through secure, PCI-DSS Level 1 compliant third-party payment gateways (such as Stripe). Top Shelf OBX, LLC does not store full credit card numbers or sensitive financial authentication details on our local servers. By providing a payment method, you authorize our processing partner to store your payment token for processing approved one-time deposits, final balances, or authorized recurring maintenance fees.
Photo / Media Release
We may take before-and-after photos or video of the work we perform on your property and use them to showcase our services, for example on our website, gallery, and social media. We do not publish your name, street address, or contact information alongside these images. If you'd prefer we not use photos of your property, simply notify us in writing prior to your scheduled service window by emailing support@topshelfobx.com, and we will honor your request.
Property Access & Responsibilities
By booking, you confirm that you own the property or are fully authorized by the owner to approve exterior services on it, and you grant us access to the exterior areas required to complete the work.
To ensure a safe and efficient visit, please complete the following before our crew arrives:
- Secure all pets indoors.
- Move vehicles, outdoor furniture, fragile items, and property away from the immediate work area.
- Ensure all windows, doors, and exterior openings are fully closed and sealed.
- Ensure a functional outdoor water spigot and/or exterior electrical outlet is unlocked and accessible where required for service.
We take extreme care with your home and property. However, Top Shelf OBX, LLC is not liable for pre-existing damage, dry-rotted wood, loose or deteriorating paint, improperly sealed windows or doors, oxidation, or unprotected electrical fixtures left exposed in the work area. If our crew identifies an unsafe condition or pre-existing defect that risks further damage, we reserve the right to pause work and consult with you before proceeding.
Cancellation, Deposit & Weather Policy
Your deposit reserves your arrival window and is applied toward your total service invoice. The remaining balance is due immediately upon job completion via the secure electronic payment link sent to your email or phone.
Cancellations & Rescheduling:
- If you cancel or reschedule 48 hours or more before your scheduled arrival window, your deposit is refunded in full to your original payment method.
- Cancellations or client-requested changes made within 48 hours of the arrival window are non-refundable, as crew scheduling and operational capacity were reserved specifically for your property.
Weather Conditions: Weather on the Outer Banks can change rapidly. If high winds, severe cold, lightning, or heavy precipitation make conditions unsafe or impractical to perform high-quality work, Top Shelf OBX reserves the right to reschedule your appointment. Your deposit automatically transfers to the rescheduled date at no penalty.
Maintenance Plans
The following terms apply specifically to recurring maintenance plan subscriptions. Where maintenance plan rules differ from standard one-time service rules, the maintenance plan terms govern.
What a Plan Is
Maintenance plans bundle your selected annual exterior services into 12 equal monthly payments. Pricing incorporates bundle, frequency, and plan discounts based on a full 12-month commitment starting on the day of your initial payment. The price shown at sign-up is locked for the entire 12-month term and will not fluctuate if standard rate cards change mid-term. Additions to property size (e.g., adding a new deck, home addition, or extra structure mid-term) are quoted and billed separately.
Recurring Payment Authorization
By subscribing, you authorize Top Shelf OBX, LLC to charge the payment card on file the exact monthly amount agreed upon at checkout, once per month, for a total of 12 consecutive billing cycles. We issue a reminder email approximately 3 days prior to each recurring charge. You may cancel your subscription at any time with one click directly from your plan page.
Booking & Managing Visits
Visits are distributed across seasonal calendar windows displayed on your account page. We notify plan subscribers approximately 3 weeks before a booking window opens to grant priority access to our service schedule. Service dates are filled on a first-come, first-served basis. If a visit is not scheduled prior to its window closing, that visit is forfeited, provided Top Shelf OBX sent at least one reminder email prior to window closure.
Single-Visit Changes
Visits changed or cancelled 48 hours or more before the arrival window remain intact for rebooking within that visit's window. Cancellations within 48 hours, or instances where our crew cannot access the property upon arrival, may cause the visit to be marked as used at our discretion.
Failed Payments
If a monthly billing charge fails, we will notify you and attempt re-billing over subsequent days. Existing booked visits will proceed, but new visits cannot be scheduled until payment clears. Uncured billing failures will result in plan termination under the early cancellation terms below.
Early Plan Cancellation & Rebalancing
Plan pricing relies on the completion of the full 12-month term. If a plan is cancelled early by you or terminated due to non-payment before completing 12 months, billing stops at the conclusion of your current paid monthly cycle, and any visits you have not yet received are cancelled at that point. At that time, we perform a standard account recalculation comparing:
- The total monthly plan payments collected to date; and
- The retail value of all visits actually completed, evaluated at our standard, non-discounted single-service rates.
If total payments made are less than the standard-rate value of services performed, an itemized final balancing invoice will be sent to your email, showing exactly how the figure was calculated and payable within 7 calendar days. We will not automatically charge the card on file for this balance. Any payment is made by you against that invoice. If total payments made exceed the standard-rate value of completed work, Top Shelf OBX, LLC will refund the difference to your original payment method.
Term Expiration
Plans automatically conclude after 12 monthly cycles and do not auto-renew without your express consent.
Disputes & Chargebacks
We are dedicated to resolving any service issues quickly and fairly. In the event of a billing error or quality dispute, you agree to contact us at support@topshelfobx.com before filing a credit card dispute or chargeback with your financial institution. Initiating a fraudulent or improper chargeback for services fully rendered constitutes a breach of contract, and you agree to reimburse Top Shelf OBX, LLC for the full disputed amount plus any administrative and chargeback processing fees incurred.
Limitation of Liability & Indemnification
To the maximum extent permitted by applicable law, Top Shelf OBX, LLC, its officers, employees, and contractors shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to our services, website availability, payment gateway downtime, or scheduling adjustments. Our total aggregate liability for any claim arising from or connected to our services shall not exceed the total dollar amount paid by you to Top Shelf OBX, LLC for the specific service visit giving rise to the claim.
You agree to defend, indemnify, and hold harmless Top Shelf OBX, LLC from any third-party claims, liabilities, costs, or damages arising from your failure to secure property access, failure to clear work areas, or misrepresentation of property ownership.
Governing Law & Severability
These terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal actions or proceedings arising under these terms shall be brought exclusively in state or federal courts located in Dare County, North Carolina. If any provision of these terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining terms shall remain in full force and effect.
